Terms and Conditions

  1. Introduction

1.1. These Terms and Conditions (the “Agreement”) constitute a binding legal agreement between you (“the Client”) and Walkys Dog Training Academy (“Walkys,” “we,” “us,” “our”), governing the Client’s use of the services, facilities, and website provided by Walkys.

1.2. By enrolling in a membership, utilising our services, or accessing our website, the Client expressly agrees to be bound by the terms outlined herein.

1.3. The Client is advised to read this Agreement carefully. If the Client does not agree to the terms of this Agreement, they must not proceed with the use of Walkys’ services or facilities.

  1. Membership Plans

2.1. Walkys offers the following membership options, subject to the terms set out below:

  • Month-to-Month Membership: 2.1.1. This membership is billed weekly via direct debit through our system and may be cancelled with a 30-day written notice as per Clause 4. 2.1.2. Upon cancellation, the membership will remain active until the end of the 30-day notice period, and the Client will be liable for any fees due during this time.

2.2. It is the Client’s responsibility to ensure compliance with the notice requirements to avoid continued billing.

  1. Payment Terms

3.1. Membership fees are payable in advance and shall be processed through the payment method provided by the Client at the time of enrolment.

3.2. The Client authorises Walkys to automatically debit the specified payment method for all recurring fees associated with their chosen membership plan.

3.3. In the event of a failed payment, Walkys reserves the right to suspend the Client’s access to facilities and services until all overdue amounts are settled.

3.4. Walkys may, at its sole discretion, revise membership fees. Written notice of such revisions shall be provided at least thirty (30) days prior to implementation. Continued use of the membership after this period constitutes acceptance of the revised fees.

  1. Cancellation Policy

4.1. All memberships are subject to the following cancellation terms:

4.1.1. Cancellations require a minimum of 30 days’ written notice, during which the membership will remain active and fees will continue to be charged.

4.1.2. Notice of cancellation must be submitted in writing via email or through the Client’s online account portal.

4.1.3. Any outstanding payments must be settled prior to the termination of the membership.

4.2. Appointments:

4.2.1. Appointments that cannot be attended may be rescheduled with a minimum of 24 hours’ notice.

4.2.2. Appointments cancelled with less than 24 hours’ notice, or missed without notification, will be charged the full amount of the session.

  1. Liability and Pet Owner Responsibilities

5.1. The Client acknowledges and agrees that, while Walkys maintains comprehensive insurance coverage, the Client assumes full responsibility for their pet while in our care.

5.2. The Client is encouraged to obtain personal pet insurance to cover potential risks, including but not limited to injury, illness, or third-party claims.

5.3. The Client warrants that their pet is in good health, fully vaccinated, and does not pose a risk to other animals or persons. Walkys reserves the right to refuse entry or remove any pet displaying signs of illness or aggressive behaviour.

  1. Use of Facilities

6.1. Membership grants the Client access to Walkys’ facilities during standard operating hours, subject to compliance with the rules and policies outlined in this Agreement.

6.2. The Client agrees to respect all instructions issued by Walkys staff and to ensure that their pet’s behaviour does not disrupt the environment or endanger other animals or persons.

6.3. Any violation of Walkys’ policies may result in suspension or termination of the Client’s membership without refund.

  1. Termination of Membership by Walkys

7.1. Walkys reserves the right to terminate the Client’s membership with immediate effect under the following circumstances:

7.1.1. Non-payment of fees;

7.1.2. Behaviour (by the Client or their pet) deemed detrimental to Walkys, its staff, or other members;

7.1.3. Breach of any provisions of this Agreement.

7.2. In the event of termination by Walkys, no refunds shall be issued, and outstanding balances shall remain payable.

  1. Amendments to Terms and Conditions

8.1. Walkys may amend this Agreement from time to time to reflect changes in operations, policies, or applicable laws.

8.2. Written notice of significant amendments shall be provided via email or published on our website. Continued use of services after notification constitutes acceptance of the amended terms.

  1. Governing Law and Jurisdiction

9.1. This Agreement shall be governed by and construed in accordance with the laws of New South Wales, Australia.

9.2. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of New South Wales.

  1. Insurance Disclaimer

10.1. While Walkys is insured for operational risks, the Client acknowledges that this coverage does not extend to individual pets.

10.2. The Client is solely responsible for any injury, illness, or damage caused by or to their pet and is strongly encouraged to secure adequate pet insurance.

  1. Miscellaneous

11.1. Memberships are non-transferable and non-refundable, except as expressly provided herein.

11.2. Walkys reserves the right to suspend services in the event of unforeseen circumstances, including but not limited to force majeure events.
